Terms and Conditions

Welcome to Bella Aurora Cafe's online ordering platform. These Terms and Conditions govern your use of our website (www.bellaauroracafe.ca) and online ordering services. By accessing our website or placing an order, you agree to be bound by these terms.

2. Acceptance of Terms

By using our online platform, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions, as well as our Return and Refund Policy. If you do not agree with these terms, please do not use our services.

3. Eligibility

You must be at least 18 years of age to place an order through our online platform. By placing an order, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

4. Account Registration

While you may browse our menu without an account, certain features may require registration. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for extended periods.

5. Online Ordering Process

5.1 Order Placement

  • You are responsible for reviewing your digital cart for accuracy, including items, modifiers, quantities, special instructions, and pickup time before submitting your order
  • All prices are displayed in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated
  • We reserve the right to refuse or cancel any order at our discretion
  • Once you submit an order, you will receive a confirmation email with order details

5.2 Order Acceptance

An order is not confirmed until you receive an email confirmation from us. We reserve the right to:

  • Refuse or cancel orders due to pricing errors, product unavailability, or suspected fraudulent activity
  • Limit order quantities per customer
  • Modify menu items and prices without prior notice

5.3 Payment

  • Payment is processed at the time of order placement
  • We accept major credit cards, debit cards, and other payment methods as displayed on our platform
  • All transactions are processed securely through our payment processor
  • You authorize us to charge the payment method provided for the total amount of your order

6. Pickup and Delivery

6.1 Pickup Orders

  • Orders are prepared to be ready at the requested pickup time
  • You must pick up your order within 30 minutes of the scheduled time
  • We are not responsible for the quality or temperature of items (including melted ice cream or cold beverages) if orders are not picked up promptly
  • Valid identification may be required at pickup
  • Orders not picked up by closing time (7:00 PM) will be discarded without refund

6.2 Third-Party Delivery

  • For orders placed through third-party platforms (UberEats, DoorDash, etc.), you are subject to the terms and conditions of those platforms
  • Issues with delivery, missing items, or delivery-related concerns must be addressed directly with the third-party delivery service
  • Bella Aurora Cafe is not responsible for delays, errors, or issues arising from third-party delivery services

7. Return and Refund Policy

All sales are final. We maintain a strict No Return, No Refund policy for health and safety reasons.

7.1 In-Store Orders

  • All transactions are final once completed
  • If your order is incorrect or does not meet quality standards, notify our staff immediately for a remake
  • No refunds or remakes will be provided for personal taste preferences or accidental orders once items are prepared

7.2 Online and Mobile Orders

  • It is your responsibility to verify order accuracy before submission
  • Once an order is marked "In Progress," it cannot be canceled or refunded
  • Orders that are not picked up (no-shows) will not be refunded or credited
  • We do not provide monetary refunds under any circumstances

7.3 Remedy

  • Our sole remedy for errors on our part is to remake the item correctly at the time of the incident
  • Quality concerns must be raised immediately upon receipt of your order

7.4 Required Acknowledgment

By completing your purchase, you acknowledge and agree that:

  • All sales are final
  • No refunds will be provided for online orders
  • You have read and accept our Return and Refund Policy

8. Merchandise and Retail Items

All retail items including coffee beans, mugs, apparel, and other merchandise are Final Sale. We do not accept returns or exchanges on these items to ensure inventory integrity.

9. Menu Items and Availability

  • Menu items, descriptions, prices, and availability are subject to change without notice
  • We make every effort to ensure menu accuracy, but errors may occur
  • Certain items may be seasonal or subject to availability
  • We reserve the right to substitute ingredients when necessary due to supply issues
  • Photos and descriptions are for illustrative purposes and may not reflect exact appearance

10. Allergies and Dietary Restrictions

  • While we strive to accommodate dietary needs and allergies, our kitchen handles various allergens
  • We cannot guarantee that any menu item is completely free from allergens
  • It is your responsibility to inform us of any allergies or dietary restrictions when ordering
  • We are not liable for allergic reactions or dietary-related issues
  • If you have severe allergies, we recommend consulting with our staff before ordering

11. Promotions and Discounts

  • Promotional offers, discounts, and coupons are subject to specific terms and conditions
  • Offers cannot be combined unless explicitly stated
  • We reserve the right to modify or cancel promotions at any time
  • Student discounts require valid student identification at pickup
  • Loyalty rewards are subject to our rewards program terms

12. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, menu descriptions, and software, is the property of Bella Aurora Cafe or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or create derivative works from our content without written permission
  • Use our trademarks, logos, or branding without authorization
  • Copy or scrape menu data or pricing information for commercial purposes

13. User Conduct

You agree not to:

  • Use our platform for any unlawful purpose or in violation of these terms
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with the proper functioning of our website
  • Submit false, misleading, or fraudulent information
  • Use automated systems or software to extract data from our website
  • Harass, threaten, or abuse our staff or other customers
  • Place duplicate or fraudulent orders

14. Privacy and Data Protection

Your privacy is important to us. We collect, use, and protect your personal information in accordance with applicable privacy laws. By using our platform, you consent to:

14.1 Mobile Terms of Service

The Bella Aurora Cafe mobile message service (the "Service") is operated by Bella Aurora Cafe ("Bella Aurora Cafe", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Bella Aurora Cafe's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Bella Aurora Cafe through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Bella Aurora Cafe. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

Opt-Out: You may opt-out of the Service at any time. Text the single keyword command STOP to +1 (844) 430-1462 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Bella Aurora Cafe mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

15. Limitation of Liability

To the fullest extent permitted by law:

  • Bella Aurora Cafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims relating to our services shall not exceed the amount paid for the relevant order
  • We are not responsible for issues caused by third-party services, including payment processors and delivery platforms
  • We are not liable for any losses resulting from unauthorized access to your account

16. Indemnification

You agree to indemnify, defend, and hold harmless Bella Aurora Cafe, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms and Conditions
  • Your use or misuse of our platform
  • Your violation of any applicable laws or regulations
  • Any false or misleading information you provide

  • Supply chain disruptions
  • Pandemics or public health emergencies

20. Termination

We reserve the right to:

  • Cancel orders suspected of being fraudulent or in violation of these terms

  • Any outstanding orders may be canceled

21. Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

21.2 Jurisdiction

You agree that any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

21.3 Informal Resolution

Before initiating any formal proceedings, we encourage you to contact us at contact@bellaauroracafe.ca to attempt to resolve any disputes informally.

22. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms and Conditions, together with our Return and Refund Policy and Privacy Policy, constitute the entire agreement between you and Bella Aurora Cafe regarding your use of our online platform and services.

24. Waiver

Our failure to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.
